Terms of Service

Makay is provided by Smithdeveloped. These Terms of Service form an agreement between you and Smithdeveloped. If you do not agree, do not use Makay. Our Privacy Policy explains how we handle personal information.

You must be at least 13 and meet the minimum digital-consent age where you live. If you are under the age of legal majority, a parent or guardian must permit your use. Give accurate information, keep your credentials private, and tell us promptly about unauthorized access. You are responsible for activity on your account.

Makay is for lawful learning. Do not use it to harm, threaten, harass, exploit, or deceive; upload unlawful material or another person's private information; infringe intellectual property; distribute malware; automate abusive access; bypass safeguards; reverse-engineer protected parts of the service; or interfere with Makay or other users.

Your school, teacher, or examination body may restrict AI assistance. You are responsible for following their rules, citing AI help when required, and submitting your own work. Makay must not be used to cheat or misrepresent authorship.

Answers, explanations, plans, image readings, and spoken replies are generated by AI. They may be inaccurate, incomplete, outdated, or inappropriate. Verify important information against trusted course material and qualified people. Makay does not provide medical, legal, financial, mental-health, emergency, or other professional advice. Do not rely on it where an error could cause harm.

You retain any rights you have in content you submit. You give Smithdeveloped a worldwide, non-exclusive license to host, copy, process, transmit, and display that content only as needed to operate, secure, and improve Makay. You confirm that you have permission to submit it and that doing so does not violate law or another person's rights. AI output may not be unique, and other users may receive similar output.

Makay's software, branding, design, and original materials belong to Smithdeveloped or its licensors. We grant you a personal, limited, revocable, non-transferable right to use Makay under these terms. These terms do not transfer ownership of Makay or third-party services.

We may add, change, suspend, or remove features and cannot promise uninterrupted or error-free availability. We may update these terms and will change the effective date and, for material changes, provide reasonable notice. Continuing to use Makay after updated terms take effect means you accept them.

You can stop using Makay or delete your account at any time. We may restrict, suspend, or terminate access when reasonably necessary to protect Makay or others, comply with law, or address a violation of these terms. Provisions that logically survive termination, including ownership, disclaimers, liability limits, and dispute terms, will remain in force.

To the fullest extent allowed by law, Makay is provided “as is” and “as available,” without warranties of accuracy, fitness for a particular purpose, merchantability, non-infringement, or availability. We do not guarantee grades, exam outcomes, deadlines, or learning results.

To the fullest extent allowed by law, Smithdeveloped and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, opportunity, profits, grades, or academic results arising from Makay. Our total liability for any claim will not exceed the greater of the amount you paid for Makay in the 12 months before the claim or US $100. Some jurisdictions do not allow certain limits, so these limits apply only where lawful.

These terms are governed by the laws of the State of New York, without regard to conflict of law rules. Before filing a claim, you and Smithdeveloped agree to try to resolve it informally for 30 days after written notice. Any unresolved dispute will be brought in the state or federal courts located in New York, unless applicable consumer law gives you the right to bring it elsewhere.

If part of these terms is unenforceable, the rest remains effective. Our failure to enforce a provision is not a waiver. You may not transfer these terms without our consent; we may transfer them as part of a reorganization, financing, sale, or service transition. These terms and the Privacy Policy are the entire agreement about your use of Makay.
